Our privacy policy and how we protect your data

1. Introduction

skydynamics llc and its affiliates, representatives, contractors, and service providers ("SkyDynamics", "Company", "we", "us", or "our") operate AeroBrain.ai, AB for Defence, related portals, APIs, demonstrations, integrations, and professional services (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, protect, and retain personal information and related customer data when you use the Service.

This policy is intended to support enterprise, aviation, and defence customers that require clear data-governance, auditability, and security commitments. It does not replace any signed data processing agreement, security schedule, or customer-specific contract. SkyDynamics does not claim ownership of customer or third-party photos, videos, documents, prompts, presentations, operational records, or other submitted, displayed, connected, or established information merely because it is processed through the Service.

2. Controller and Processor Roles

For account administration, website visitors, marketing contacts, billing contacts, and security operations, SkyDynamics may act as an independent controller. For Customer Materials processed on behalf of an enterprise customer, SkyDynamics generally acts as a processor or service provider, and the customer remains the controller or equivalent decision-maker.

Where required, we will enter into a data processing agreement that defines processing instructions, subprocessors, security measures, data subject rights assistance, breach notification, audits, transfers, deletion, and return of Customer Materials.

3. Information We Collect

3.1 Information You Provide

We collect information that you provide directly to us, including:

  • Account Information: Name, email address, password, phone number, company name, and job title
  • Profile Information: Profile picture, preferences, and other profile data
  • Operational Data: Flight, fleet, crew, roster, maintenance, training, safety, technical-log, dispatch, OCC, and management data you input into or connect to the Service
  • Customer Materials: Prompts, retrieved source references, documents, manuals, photos, videos, audio, screenshots, presentations, third-party materials, outputs, feedback, safety classifications, audit events, and usage metadata submitted to, connected with, displayed in, or generated through the Service
  • Defence or Government Data: Information submitted by authorised defence, ministry, or public-sector customers, subject to the applicable customer agreement, classification rules, and deployment scope
  • Payment Information: Billing address, payment method details (processed through secure third-party payment processors)
  • Communication Data: Messages, feedback, support requests, and other communications you send to us

3.2 Automatically Collected Information

We automatically collect certain information when you use the Service:

  • Usage Data: Pages visited, features used, time spent, clicks, and navigation patterns
  • Device Information: IP address, browser type, operating system, device type, and device identifiers
  • Log Data: Access times, authentication events, API usage, error logs, audit logs, security events, retrieval traces, and system performance data

3.3 Information from Third Parties and Integrations

We may receive information from authentication providers, productivity suites, airline systems, maintenance systems, training platforms, databases, analytics tools, cloud infrastructure, payment processors, and business partners, only where authorised by you, your organisation, or the applicable customer agreement.

4. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Service
  • Process transactions and send related information, including confirmations and invoices
  • Send technical notices, updates, security alerts, and administrative messages
  • Respond to your comments, questions, and requests
  • Monitor and analyze usage patterns and trends to improve user experience
  • Detect, prevent, and address technical issues, fraud, and security threats
  • Personalize your experience and provide customized content and recommendations
  • Provide AI-assisted retrieval, summaries, recommendations, auditability, provenance, and decision-support workflows
  • Maintain tenant isolation, security monitoring, rate limits, usage quotas, billing metrics, and enterprise governance controls
  • Support customer-requested integrations, migration, professional services, security review, and incident response
  • Host, store, process, transmit, display, and secure Customer Materials only as necessary to provide, protect, maintain, support, and improve the Service or as otherwise directed by the customer
  • Send marketing communications (with your consent, where required by law)
  • Comply with legal obligations and enforce our Terms of Use
  • Facilitate business transfers, mergers, or acquisitions

5. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

5.1 Service Providers and Subprocessors

We share information with service providers who perform services on our behalf, such as hosting, cloud infrastructure, security monitoring, payment processing, analytics, email delivery, customer support, logging, and AI infrastructure. These providers are contractually obligated to protect information and process it only for authorised purposes. We do not sell Customer Materials, and we do not authorize service providers to use Customer Materials for their own marketing or unrelated product development.

5.2 Customer-Directed Integrations

If your organisation connects third-party systems, databases, productivity suites, or operational platforms, information may be shared with those systems according to your configuration, your instructions, and the third party's terms. You are responsible for ensuring that you have the required rights and permissions to send Customer Materials to those integrations.

5.3 Business Transfers

In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred to the acquiring entity.

5.4 Legal, Safety, Security, and Regulatory Requirements

We may disclose your information if required by law, court order, or government regulation, or if we believe disclosure is necessary to protect our rights, property, or safety, or that of our users or others.

5.5 With Your Consent

We may share your information with your explicit consent or at your direction.

6. Data Security

SkyDynamics employs industry-standard security measures to protect your information, including:

  • Encryption of data in transit and at rest
  • Secure authentication and access controls
  • Tenant isolation, role-based access controls, API-key controls, and audit logging where applicable
  • Regular security assessments and penetration testing
  • Employee training on data protection
  • Incident response procedures

However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Please notify us immediately if you become aware of any unauthorized access.

7. AI, Prompts, Outputs, and Model Improvement

We process prompts, source documents, photos, videos, presentations, retrieval traces, outputs, feedback, and usage metadata to provide the Service, maintain auditability, troubleshoot issues, improve retrieval quality, and enforce security and usage controls. This processing does not transfer ownership of Customer Materials to SkyDynamics.

We do not use enterprise Customer Materials to train third-party foundation models unless expressly authorised by the customer in a signed agreement or configuration. Where customers choose external model providers, their use may be subject to additional provider terms and data-processing settings.

SkyDynamics retains ownership of the Service and its technology, including software, models, workflows, retrieval methods, security controls, audit systems, know-how, and product improvements. Customers and third parties retain ownership of their respective Customer Materials and underlying rights.

8. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

When determining retention periods, we consider the nature of the data, the purposes for which we process it, legal requirements, and the potential risk of harm from unauthorized access or disclosure.

Upon account deletion or contract termination, we will delete, return, anonymize, or retain personal information and Customer Materials in accordance with the applicable customer agreement, legal requirements, backup cycles, security obligations, tax and accounting requirements, dispute-preservation needs, and legitimate business interests such as fraud prevention and service integrity.

9. Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal information:

9.1 Access and Portability

You can request access to your personal information and receive a copy in a structured, machine-readable format.

9.2 Correction

You can update or correct your personal information through your account settings or by contacting us.

9.3 Deletion

You can request deletion of your personal information, subject to legal and contractual restrictions.

9.4 Opt-Out

You can opt-out of marketing communications by using the unsubscribe link in emails or adjusting your communication preferences in your account settings.

11. Defence, Government, and Sensitive Deployments

Defence, ministry, government, classified, export-controlled, or otherwise sensitive deployments must be governed by a customer-specific agreement defining authorised users, deployment boundaries, data classification, security controls, retention, logging, incident handling, subcontractors, and transfer restrictions. Do not upload classified, export-controlled, or restricted data to a public or unmanaged environment unless the applicable agreement and deployment are approved for that data.

12. Children's Privacy

The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child, we will take steps to delete such information promptly.

13. Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of third parties. We encourage you to review the privacy policies of any third-party sites you visit.

14. Changes to This Privacy Policy
